ЗАБЕЗПЕЧЕННЯ ПРАВА НА ОХОРОНУ ЗДОРОВ'Я ЯК СТРАТЕГІЧНИЙ НАЦІОНАЛЬНИЙ ПРІОРИТЕТ

Анотація

Статтю присвячено дослідженню проблеми забезпечення права на охорону здоров'я у вітчизняному правовому полі, яке визначено як стратегічний національний пріоритет України в умовах глобалізованих епідемічних викликів.
Обгрунтовано, що здоров'я є найбільшою цінністю людського життя. Право на здоров'я належить до соціальних прав, а його втрата нівелює значення усіх інших благ. Головною особливістю цього права є його невідчужуваність, оскільки людина володіє цим правом упродовж усього життя. Доведено, що права громадян у сфері охорони здоров'я — це широке поняття, яке включає в себе не лише безпосередньо права, але й взаємні обов'язки і людини, і суб'єктів публічного управління у зазначеній сфері. Доведено, що у сучасному технологічному світі стан здоров'я виступає головним чинником на шляху до прагнення особи стати повноцінним членом суспільства, мати освіту, роботу, бути активними учасником громадянського суспільства. Зазначено про необхідність удосконалення існуючої законодавчої бази, розробки та реалізації нових та сучасних стратегічних документів, що сприятимуть розвитку суспільного здоров'я та гарантуватимуть кожному громадянину право на охорону власного здоров'я, що актуалізує потребу належного правового нормопроєктування та належної правореалізації, особливо з огляду на медичну реформу, що здійснюється в Україні.

ENSURING THE RIGHT TO HEALTH CARE AS A STRATEGIC NATIONAL PRIORITY

Summary

The article is devoted to the study of the problem of ensuring the right to health care in the domestic legal field, which is defined as a strategic national priority of Ukraine in the context of globalized epidemic challenges.
It is argued that health is the greatest value of human life. The right to health belongs to social rights, and its loss negates the importance of all other benefits. The main feature of this right is its inalienability, because a person has this right throughout life. It has been proven that the rights of citizens in the field of health care is a broad concept that includes not only the rights themselves, but also the mutual responsibilities of both the person and the subjects of public administration in this area. It is proved that in the modern technological world the state of health is the main factor on the way to the desire of a person to become a full member of society, to have an education, a job, to be an active participant in civil society.
It was found that the legal basis governing public relations in the field of health care in Ukraine is quite strong. In addition to the Constitution, the legal framework in this area is also a number of other laws, including the Fundamentals of Legislation of Ukraine on Health, On Ensuring Sanitary and Epidemic Welfare, On Protection of Infectious Diseases, On Medicines, On State Financial Guarantees of Medical public service, etc. This area is also regulated by Decrees of the President of Ukraine: On approval of the Regulations on the Ministry of Protection of Ukraine, the Concept of Health Development of the Population of Ukraine, On the Strategy of Sustainable Development "Ukraine — 2020", etc. The normative and legal basis of the state policy in the field of health care is also the Orders of the Ministry of Health of Ukraine.
The Constitution of Ukraine stipulates that health care is provided through state funding of relevant programs: health and prevention, health care, socio-economic, etc. The state realizes the right to health care through the creation of appropriate conditions for affordable and effective provision of medical services, development of medical institutions of all forms of ownership, ensures sanitary and epidemic well-being.
The need to improve the existing legal framework, develop and implement new and modern strategic documents that will promote public health and guarantee every citizen the right to health care, which highlights the need for proper legal regulation and proper enforcement, especially given the medical reform underway in Ukraine.
