ВДОСКОНАЛЕННЯ СИСТЕМИ УПРАВЛІННЯ МИТНИМИ РИЗИКАМИ У СФЕРІ МИТНОГО КОНТРОЛЮ З УРАХУВАННЯМ ЗАРУБІЖНОГО ДОСВІДУ
Анотація
У статті проаналізовано систему управління митними ризиками у сфері митного контролю України та Європейського Союзу. Запропоновано напрями удосконалення системи управління митними ризиками у сфері митного контролю з урахуванням зарубіжного досвіду, а саме: удосконалення законодавчого забезпечення цієї діяльності; розбудова організаційної структури; розроблення та затвердження порядку виконання митних формальностей; організаційне супроводження процесів управління ризиками; вдосконалення процесів управління ризиками та налагодження ефективної взаємодії учасників; упровадження сучасних інформаційних технологій аналізу та оцінки ризиків; застосування додаткових механізмів верифікації результатів митного контролю; внесення до Митного кодексу України змін щодо можливості прийняття митницями попередніх рішень з питань визначення митної вартості товарів; ресурсне забезпечення та підготовка персоналу. Запропоновані напрями удосконалення системи управління митними ризиками у сфері митного контролю з урахуванням провідного зарубіжного досвіду дадуть змогу забезпечити використання в Україні сучасної, гнучкої, багатофункціональної системи управління митними ризиками, основною метою якої є досягнення оптимального балансу між спрощенням процедур міжнародної торгівлі та забезпеченням належного рівня контролю.

IMPROVEMENT OF THE CUSTOMS RISK MANAGEMENT SYSTEM IN THE FIELD OF CUSTOMS CONTROL WITH CONSIDERATION OF FOREIGN EXPERIENCE
Summary
The article analyzes the system of customs risks management in the field of customs control of Ukraine and the European Union. It is determined that modern customs control instruments should be aimed at strengthening the foreign economic security of the state and creating favorable conditions for the movement of goods across the state border by simplifying and accelerating customs procedures. It was investigated that the necessity of research of theoretical and applied aspects of risk management in the customs business is conditioned by: urgent need for unification of the domestic legal and regulatory framework in the field of customs with international customs standards; the formation of the latest trends leading to the revision of approaches to ensuring the increase of the effectiveness of customs control; actualization of issues of formation of an effective system of risk management in the context of customs control; the need to systematize international experience in risk management in the customs field. It was investigated that in Ukraine, the analysis, identification and assessment of risks, the development and implementation of practical measures for risk management, results and correction of the measures taken are carried out by the bodies of the State fiscal service. It was established that the application of the automated system of analysis and risk management as an automated component of the risk management system enables to automate the selection of customs declarations or transfers of goods, vehicles, persons across the state border, which should strengthen customs control, determine the list of customs formalities and record information , made by customs officials on the results of customs formalities carried out. The article studies that the Ukrainian risk management system was created and developed taking into account international standards and leading international experience. The customs risk management system in the European Union is explored and the main directions of the customs risk management system in the European Union are the management of the risks of the supply chain of goods, which includes: identification and control of the movement of high-risk goods; creation of simplified conditions for the implementation of foreign trade through the development of the institution of an authorized economic operator; preliminary analysis of the information provided to the subjects of foreign economic activity before departure or arrival of goods. It has been determined that at the present stage, the priority of improving the legal and regulatory support of the risk management system for the movement of goods and vehicles across the border should be a clear definition of the sequence of actions of customs officials who work in different points of passage, as well as introduction of common approaches to the order of application of the existing software provision and technical means of customs control.
The directions of improvement of the customs risk management system in the field of customs control, taking into account foreign experience, are proposed, namely: improvement of legislative provision of this activity; organizational structure development; development and approval of the procedure for customs formalities; organizational support of risk management processes; improvement of risk management processes and establishment of effective interaction of participants; introduction of modern information technologies for risk analysis and assessment; application of additional mechanisms for verification of the results of customs control; introduction of amendments to the Customs Code of Ukraine regarding the possibility of customs clearance of preliminary decisions on the determination of the customs value of goods; resource support and staff training. The proposed directions of improvement of the customs risk management system in the field of customs control, taking into account the leading foreign experience, will enable the use of modern, flexible, multifunctional customs risk management system in Ukraine, the main objective of which is to achieve an optimal balance between the simplification of international trade procedures and the provision of an adequate level of control.
