ІНСТИТУЦІЙНІ ПЕРЕДУМОВИ ТА ФАКТОРИ ТРАНСФОРМАЦІЇ ДЕРЖАВНОЇ СЛУЖБИ В КОНТЕКСТІ ЄВРОПЕЙСЬКОЇ ІНТЕГРАЦІЇ

Анотація

У статті обгрунтовано інституційні передумови та фактори трансформації державної служби в контексті Європейської інтеграції. Проаналізовано наслідки запровадження принципів адміністрації державного управління, що є спільними для держав-членів ЄС. Обгрунтовано, що у державах-членах ЄС такі принципи вбудовані або представлені у вигляді низки нормативно-правових актів таких, як адміністративні процедурні кодекси, адміністративні процесуальні кодекси, закони про свободу інформації, закони про державну службу ЄС; проаналізовано сутнісні риси концепцій державної служби в країнах ЄС.
Важливою інституційною передумовою трансформації державної служби є прерогативи її функціональних вимірів. Встановлено, що згідно із загальноєвропейським директивам державні службовці повинні дотримуватися ряду юридичних умов, які дозволяють їм ефективно здійснювати свої функції і повноваження. Це стосується їх прав і обов'язків, професійної стабільності, захисту від політичного посягання і втручання лобістів, адекватного рівня заробітної плати з метою зниження ймовірності корупції, дисциплінарних положень і відбору при прийомі на державну службу.
Доводиться, що розвиток політики ЄС у сфері державного управління (публічної адміністрації) є проміжним продуктом розробки і реалізації спільних політик у різних секторах і правових вимог щодо адміністративних структур і процедур у державах-членах.

INSTITUTIONAL PRECONDITIONS AND FACTORS OF TRANSFORMATION OF CIVIL SERVICE IN THE CONTEXT OF EUROPEAN INTEGRATION

Summary

Institutional preconditions and factors of transformation of civil service in the context of European integration were justified in the article. Consequences of the introduction of the principles of management of public administration that are common to the EU Member States were analyzed. It was proved that these principles are embedded or presented as a series of normative and regulatory acts in the EU Member States, such as administrative procedure codes, freedom of information laws, civil service laws of the EU; the essential features of the concepts of civil service in the EU were analyzed.
An important institutional precondition for transformation of the civil service is prerogatives of its functional measurements. It was established that according to the general European directives civil servants should follow some legal terms, which allow them to effectively carry out their functions and powers. This applies to their rights and duties, professional stability, protection from political encroachment and intervention lobbyists, adequate level of salary in order to reduce the likelihood of corruption, disciplinary provisions and selection for admission to the civil service.
It was proved that the development of the EU policy in the area of public administration is an intermediate product of development and implementation of common policies in various sectors and legal requirements on administrative structures and procedures in the EU Member States.
